WHEREAS, Section 16 of the Local Government Code stated that every local government unit shall exercise the power expressly granted, those necessary implied therefrom, as well as powers necessary, appropriate, or incidental to for its efficient and effective governance, and those which are essential to the promotion of the general welfare of the people within its territorial jurisdiction, and the public general;

WHEREAS, Section 458 of the Local Government Code mandates the Sangguniang Panlungsod to provide for an efficient and effective system of solid waste and garbage collection, disposal, prohibit littering and the placing or throwing of garbage, refuse and other filth and waste;

WHEREAS, RVM is a machine that allows a person to insert a used or empty glass bottle, plastic bottle or aluminum can in exchange for a reward. The machine has gained recognition around the world due to its economic and environmental benefits;

WHEREAS, the City Government of San Juan intends to install RVM in some public areas in order to encourage and ensure proper segregation, collection and transportation of solid waste and to formulate a best environmental practice in waste management;

WHEREAS, EWBTI is a corporation that designs and contracts construction of various machines, industrial machineries and special machineries including VRM:

WHEREAS, the City Legal Officer has certified that the MOA is in order and not contrary to existing laws, rules and regulations;

NOW THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVEDBY THE SANGGUNIANG PANLUNGSOD OF THE CITY OF SAN JUAN, AND BY VIRTUE OF THE POWERS VESTED IN IT Y LAW, in a session duly assembled, to authorize the City Mayor Francisco Javier M. Zamora, to enter into a MOA with (EWBTI), for the installation and operation of RVM to some designated public places in the City of San Juan to effectively practice a best environmental waste management.

RESOLVED FURTHER, that the authority, issuance and approval hereof is subject to certain restrictions and to all existing laws, circulars, rules and regulations.
