WHEREAS, Section 22 (c) of Republic Act No. 7160, otherwise known as the “Local Government Code of 1991”, provides that: “Unless otherwise provided in this Code, no contract may be entered into by the local chief executive in behalf of the local government unit without prior authorization by the Sanggunian concerned xxx.”

WHEREAS, Section 455 (b) (1) (vi) of the same code provides that the City Mayor shall “represent the city in all its business transactions and sign in its behalf all bonds, contracts, and obligations, and such other documents upon authority of the Sangguniang Panlungsod or pursuant to law or ordinance”;

WHEREAS, the City Government of San Juan is the owner of stalls at the City Plaza of San Juan located at N. Domingo Street;

WHEREAS, the lease of the City Plaza Stalls shall cover the period January 01 to December 31, 2021;

WHEREAS, the City Legal Officer has certified that the same is in order and not contrary to existing laws, rules and regulations;

NOW THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVEDBY THE SANGGUNIANG PANLUNGSOD OF THE CITY OF SAN JUAN, AND BY VIRTUE OF THE POWERS VESTED IN IT BY LAW, to authorize the City Mayor, Honorable Francisco Javier M. Zamora to enter into a contract of lease for stalls at the City Plaza of San Juan, N. Domingo Street for the period January 01 to December 31, 2021;

RESOLVED FURTHER, that the authority, issuance and approval hereof is subject to certain restrictions and to all existing laws, circulars, rules and regulations.
