WHEREAS, Section 22 (c) of Republic Act No. 7160, otherwise known as the “Local Government Code of 1991”, provides that: “Unless otherwise provided in this Code, no contract may be entered into by the local chief executive in behalf of the local government unit without prior authorization by the Sanggunian concerned. xxx”

WHEREAS, Section 455 (b) (1) (vi) of the same code provides that the City Mayor shall “represent the city in all its business transactions and sign in its behalf all bonds, contracts, and obligations, and such other documents upon authority of the Sangguniang Panlungsod or pursuant to law or ordinance”;

WHEREAS, the property is located at 3^rd West Crame, Barangay Greenhills, San Juan City, covered by Transfer Certificate of Title (TCT) No. 21-020-00093 and Tax Declaration No. 12225-R;

WHEREAS, the City Legal Officer has certified that the same is in order and not contrary to existing laws, rules and regulations;

NOW THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED BY THE SANGGUNIANG PANLUNGSOD OF THE CITY OF SAN JUAN, AND BY VIRTUE OF THE POWERS VESTED IN IT BY LAW, in a session duly assembled, to authorize the City Mayor, Honorable Francisco Javier M. Zamora to negotiate for the acquisition and to enter into a Contract of Deed of Absolute Sale with Breda Enterprises Inc.

RESOLVED FURTHER, that the authority, issuance and approval hereof is subject to certain restrictions and to all existing laws, circulars, rules and regulations.
