CITY RESOLUTION NO. 76
Series of 2022
WHEREAS, pursuant to R.A. No. 6234, as amended, the MWSS shall own and/or have jurisdiction, supervision and control over all waterworks and sewerage system in the City of San Juan, Metro Manila;
WHEREAS, the MWSS is the owner of the subject properties located at Santolan Road, Barangay Little Baguio, San Juan City with (1) Property Identification No. 116-00-019-06-070-0000 under Tax Declaration No. 17-910149 and (2) Property Identification No. 116-00-021-22-066-0000 under Tax Declaration No. 17-910050, currently under the possession of the City of San Juan;
WHEREAS, the City Government of San Juan is mandated by R.A. No. 7160 to exercise power necessary, appropriate or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare;
WHEREAS, in order to fully serve and provide better facility to its constituents, the City Government of San Juan is proposing to construct and build a Multi-Purpose Building;
WHEREAS, MWSS and the City Government of San Juan have agreed to the building and construction of the proposed project within the subject property, provided that the construction, operation and maintenance thereof, shall be accomplished with due regards to the rights of MWSS and its concessionaire, MWCI, without compromising the integrity of the aqueduct and other related structures for water supply and sewerage services located therein and the necessary access thereto for the purpose of the maintenance and/or operation thereof;
WHEREAS, the Deed of Usufruct is beneficial to the City Government of San Juan considering that such provision of a facility will redound to their efficiency and productivity in rendering public service;
NOW THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED BY THE SANGGUNIANG PANLUNGSOD OF THE CITY OF SAN JUAN, AND BY VIRTUE OF THE POWERS VESTED IN IT BY LAW, in a session duly assembled, to authorize the City Mayor to enter into a Deed of Usufruct with MWSS for the implementation of the proposed project within the property located at Santolan Road, Barangay Little Baguio, San Juan City;
RESOLVED FURTHER, that the authority, issuance and approval hereof is subject to certain restrictions and to all existing laws, circulars, rules and regulations.
