CITY RESOLUTION NO. 77
Series of 2022
WHEREAS, Section 22 (c) of Republic Act No. 7160, otherwise known as the “Local Government Code of 1991” provides that: “Unless otherwise provided in this Code, no contract may be entered into by the local chief executive in behalf of the local government unit without prior authorization by the Sanggunian concerned xxx”;
WHEREAS, Section 455 (b) (1) (vi) of the same code provides that the City Mayor shall “represent the city in all its business transactions and sign in its behalf all bonds, contracts and obligations, and such other documents upon authority of the Sangguniang Panlungsod or pursuant to law or ordinance;
WHEREAS, the City Government of San Juan is the owner of the stalls at the City Plaza, N. Domingo Street, San Juan City;
WHEREAS, the following stall owners are desirous of renewing their Contract of Lease at City Plaza:
- Stall No. 4- Maria Teresita Dominguez (Mr. Quickie)
- Stall No. 8- Ruth D. Ampati (Dental Clinic)
- Stall Nos. 9, 10 and 11 – Caroline Cue (Finti Kantina)
- Stall Nos. 12 and 13- Lulu Gavino (Aling Lulu’s)
- Stall Nos. 16 and 17 – Macky R. Mendoza (Banang ni Macky Eatery)
- Stall Nos. 18 and 19- Ma. Ruth Rin (Beniqueyelle Enterprises)
- Stall No. 20- Genard Vincent Abragan (Genvin Airconditioning Services)
- Stall No. 21- Ma. Luisa G. Supan (Iravy’s Facial Care)
WHEREAS, the lease of the City Plaza Stalls shall cover the period January 01 to December 31, 2022;
WHEREAS, the City Legal Officer has certified that the Contract of Lease is in order and not contrary to existing laws, rules and regulations;
NOW THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED BY THE SANGGUNIANG PANLUNGSOD OF THE CITY OF SAN JUAN, AND BY VIRTUE OF THE POWERS VESTED IN IT BY LAW, in a session duly assembled, to authorize the City Mayor Francisco Javier M. Zamora, to enter into a Contract of Lease for stalls at the City Plaza, N. Domingo St., San Juan City, for the period of January 01 to December 31, 2022;
RESOLVED FURTHER, that the authority, issuance and approval hereof is subject to certain restrictions and to all existing laws, circulars, rules and regulations.
