WHEREAS, Section 16 of the Local Government Code of 1991 provides that every local government unit shall, among things, promote the health, safety, and preserve the comfort and convenience of their inhabitants;
WHEREAS, the City Government of San Juan has its own Medical Center which is mandated to provide the best possible primary health care services to its clients;
WHEREAS, the San Juan Medical Center is a Primary Care Level Facility with limited scope and services, thus, it cannot fully provide all the medical needs of its patients;
WHEREAS, the San Juan Medical Center being a Primary Care Level Facility has its inherent limitations with regards to its clinical scope and in its ancillary and diagnostic services, thus, it may not be fully provided for all the health care needs of its patients at all times;
WHEREAS, to facilitate continuity of care and ensure the best possible health outcome for its clients, there is a need to refer them to other health care facilities which are capable of providing the needed medical and ancillary services;
WHEREAS, the City Government of San Juan through the San Juan Medical Center may enter into contract with accredited private health facility in or near its area to provide the needed drug, test, service or procedure to the eligible beneficiaries in pursuant to Section VI.3.e of DOH Administrative Order No 2020-0060 dated December 23, 2020, “Revised Guidelines on the Implementation of the Medical Assistance to Indigent Patients (MAIP) Program” and Section 10.D of the Republic Act No. 11463-Malasakit Center Act;
WHEREAS, the City Legal Officer has certified that the Memorandum of Agreement is in order and not contrary to existing laws, rules and regulations.
NOW THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED BY THE SANGGUNIANG PANLUNGSOD OF THE CITY OF SAN JUAN, AND BY VIRTUE OF THE POWERS VESTED IN IT BY LAW, to authorize the City Mayor Francisco Javier M. Zamora to enter into Memorandum of Agreement with University of the East Ramon Magsaysay Memorial Medical Center.
RESOLVED FURTHER, that the authority, issuance and approval hereof is subject to certain restrictions and to all existing laws, circulars, rules and regulations.
