WHEREAS, the 1987 Constitution of the Republic of the Philippines recognizes the right of the people to live in a balanced and healthful ecology in accord with rhythm and harmony of nature;
WHEREAS, Republic Act 7160 or the Local Government Code (LGC) of 1991 mandates all Local Government Units to ensure and promote the health and safety of the people and enhance their right to a balance ecology;
WHEREAS, with reference to the foregoing 1991 LGC mandate, the Supreme Court issued a writ of continuing mandamus for the Clean-Up and Rehabilitation of Manila Bay under the Manila Bay Clean Up and Rehabilitation PreservationProgram (MBCRPP);
WHEREAS, the implementation of the MBCRP, the conduct of LGU Compliance Assessment is undertaken annually to evaluate the LGU’s compliance to the Key Performance Indicators with the goal of ensuring that the LGU will develop and scale up its capacity to become environment-protective, cliamte change adaptive, and disaster resilient;
WHEREAS, per MBCRPP 2021 LGU Compliance Assessment Result under the Liquid Waste Management catergory, the City of San Juan is required to address the absence of a Drainage Master Plan;
WHEREAS, the presence of a Drainage Master Plan will help address the major causes of flooding such as rapid urban development, inadequacy of flood control structures, indiscriminate dumping of solid wastes, encroachments of waterways, concerns on land use planning and excessive rainfall.
NOW THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVEDby the SangguniangPanlungsod of the City of San Juan, Metro Manila in a session duly assembled, to ADOPT and APPROVE the Comprehensive Flood Control and Drainage Master Plan of the City of San Juan.
RESOLVED FURTHER, the authority, issuance and approval hereof is subject to compliance by the City Government on existing laws, circulars, rules and regulations.
RESOLVED FINALLY, that copies of this resolution be furnished to all concerned national and local agencies.
