WHEREAS, Section 16, Article XIV of the 1987 Philippine Constitution states that “All the country’s artistic and historic wealth constitutes the cultural treasure of the nation and shall be under the protection of the State which may regulate its disposition”;
WHEREAS, Section 16 of Republic Act 7160, otherwise known as the “Local Government Code of 1991” mandates local government units to ensure and support, among other things, the preservation and enrichment of culture;
WHEREAS, the City Government of San Juan is the owner and possessor of three (3) artistic and historical monuments namely: DR. JOSE RIZAL, situated at Plaza ng Masa, N. Domingo Street, San Juan City, Metro Manila; GAT ANDRES BONIFACIO, situated at Pinaglabanan Street, corner Valenzuela Street, San Juan City, Metro Manila; and GEN. EMILIO JACINTO, situated at Pinaglabanan Street, corner P. Narcisco Street, San Juan City, Metro Manila;
WHEREAS, San Juan City deemed it necessary to preserve the monuments by transferring them into a more secure and appropriate place considering that the said historic and artistic memorials are located in open and busy streets that might cause damage and loss;
WHEREAS, San Juan City, through the Sangguniang Panlungsod of San Juan, issued City Ordinance No. 52 and 55, Series of 2021, respectively, ordering the relocation of Dr. Jose Rizal, Gat. Andres Bonifacio and Gen. Emilio Jacinto monuments at Pinaglabanan Shrine, Pinaglabanan Street, San Juan City, Metro Manila;
WHEREAS, the NHCP is a government agency which is responsible for the conservation and preservation of country’s historical legacies including the San Juan City’s artistic and historical statues;
WHEREAS, San Juan City and NHCP agreed that the subject monuments shall be relocated at the Pinaglabanan Shrine under the administration of NHCP through a Usufruct Agreement subject to the terms and regulations as provided by law;
WHEREAS, the City Legal Officer has certified that the Usufruct Agreement is in order and not contrary to existing laws, rules and regulations.
NOW THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod of the City of San Juan, in a session duly assembled that, hereby authorizes the City Mayor, Honorable Francisco Javier M. Zamora, to sign a Usufruct Agreement with the NHCP for and on behalf of the City Government of San Juan to allow the relocation of Dr. Jose Rizal, Gat. Andres Bonifacio and Gen. Emilio Jacinto’s monuments at Pinaglabanan Shrine, Pinaglabanan Street, San Juan City, Metro Manila, Philippines.
RESOLVED FURTHER, that the authority, issuance and approval hereof is subject to certain restrictions and to all existing laws, circulars, rules and regulations.
RESOLVED FINALLY, that a copy of this Resolution be furnished the NHCP and all concerned City Government Departments and offices for their information, guidance and reference.
