Legislative Information Tracking and Administration System

WHEREAS, Meralco is a grantee of the legislative franchise pursuant to R.A. 9209, to operate and maintain a distribution system in cities/municipalities of Metro Manila, Bulacan, Cavite and Rizal, and certain cities/municipalities/barangays in Laguna, Quezon, Pampanga and Batangas;

WHEREAS, the City Government of San Juan is the owner of a property described under Tax Declaration of Real Property No. 21-010-00001 of the City of San Juan, Metro Manila;

WHEREAS, Meralco proposes for the installation, removal and replacement of electrical facilities and all accessories and appurtenances connected, including the installation of poles and wires, trimming of trees, free access for repairs, inspection, maintenance, upgrade and all other works or acts necessary for public safety and the preservation of the electrical facilities and other customers that may in the future need electrical service in the said right of way;

WHEREAS, the City Government of San Juan shall not finance nor be responsible for the construction, installation, operation and maintenance of the electrical facilities;

WHEREAS, the City Legal Officer has reviewed the pertinent documents related to this matter and has duly certified that the grant is in order and not contrary to existing laws, rules and regulations and that the City Mayor may sign the grant of right of way with Meralco.

NOW THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod of the City of San Juan, Metro Manila, in a session duly assembled, to authorize the City Mayor to enter into a Grant of Right of Way with MERALCO for its property located along Santolan Road, Barangay St. Joseph, San Juan City.

RESOLVED FURTHER, that the authority, issuance and approval hereof is subject to certain restrictions and to all existing laws, circulars, rules and regulations.
