WHEREAS, the Philippine Constitution declares that “no resettlement of urban or rural dwellers shall be undertaken without adequate consultation with them and the communities where they are to be relocated”;

WHEREAS, Presidential Decree 757 aims to “develop and implement a comprehensive and integrated housing program which shall embrace, among others, − housing development and resettlement”;

WHEREAS, Section 28 of the Republic Act 7279 or the Urban Development and Housing Act of 1992 states provisions on the eviction and demolition of informal settler families;

WHEREAS, Section 29 of the Republic Act 7279 or the Urban Development and Housing Act of 1992 emphasizes the role of the local government units in coordination with the National Housing Authority the implementation of relocation and resettlement of persons living in danger areas;

WHEREAS, Memorandum Circular No. 2020-045 of the National Housing Authority provides guidelines for the formulation of the Resettlement Action Plan;

WHEREAS, In the activity entitled “Formulation of the Drainage Master Plan and Updating of the Relocation and Resettlement Action Plan” conducted on May 18-20, 2022, members of the Local Housing Board and other duty bearers were guided by the National Housing Authority-Resettlement and Development Services Department (NHA-RDSD) in the crafting of the Resettlement Action Plan of 2023-2025;

WHEREAS, the Relocation and Resettlement Action Plan 2023-2025 of the City of San Juan is an output of the aforementioned activity, data collection and consolidation as well as consultation with concerned offices and department, national government agencies, the academe and non-government organizations;

WHEREAS the approval and adoption of the Relocation and Resettlement Action Plan of 2023-2025 will be the basis for all programs, projects and activities pertaining the relocation of informal settler families along waterways and their resettlement in off-city or in-city housing sites;

WHEREAS, it is the Local Housing Board who will be primarily responsible for the implementation of the Resettlement Action Plan of 2023-2025 while the Local Housing Board Secretariat is given the task of submitting reportorial requirements as determined by the body or other stakeholders;

NOW THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod of the City of San Juan, in a session duly assembled that the Resettlement Action Plan for the years 2023-2025 of San Juan City is hereby adopted.

RESOLVED FURTHER, that the aforementioned Resettlement Action Plan of 2023-2025, shall form integral part of this Resolution.
