WHEREAS, the water bodies in Metro Manila, particularly the Maytunas Creek and Ermitaño Creekboth covering from upstream to downstream (the “Adopted Water Bodies) which are tributaries of San Juan River, have reached a deteriorated condition which are nearby estero communities, even with the help of the government, can no longer address effectively without help from the private and non-government sectors
WHEREAS, most of the rivers have become stagnant because of the huge volume of silt, wastes, and other debris and have become a continuing threat to the health and safety of the riverside communities.
WHEREAS, the occurrence of diseases like dengue, acute gastro-enteritis and soil-transmitted helminthiasis continue to affect the health of estero residents, particularly children;
WHEREAS, the MMDA is a government agency mandated to be the primary agency responsible for solid waste disposal and management and flood control management;
WHEREAS,the MWSS is a government agency mandated to ensure an uninterrupted and adequate supply, and distribution of potable water for domestic and other purposes and the proper operation and maintenance of sewerage systems in its service area;
WHEREAS, the City Government of San Juan is mandated to promote health and safety, and enhance the right of the people to a balance ecology, and desire to cooperate with MWCI and the foregoing government agencies to improve the environmental condition of the Adopted Water Bodies;
WHEREAS, the MWCI and MWSS are tasked to provide water delivery as well as sewerage and sanitation services in the East Service Area of the MWSS’ franchise area in accordance with the Concession Agreement dated February 21, 1997, and pursuant thereto, Manila Water has the sole right to manage, operate and maintain all fixed and movable assets of MWSS that may be required to provide the water delivery as well as sewerage and sanitation services;
WHEREAS, Adopt an Estero/Water Body Program-Trash Trap Program dated November 25, 2021, was developed which promote collaboration between and among private and non-government sectors, Local Government Unit/s and other government agencies to clean esteros and water bodies;
WHEREAS, the City Legal Officer has certified that the MOA is in order and not contrary to existing laws, rules and regulations;
NOW THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED,BY THE SANGGUNIANG PANLUNGSOD OF THE CITY OF SAN JUAN, AND BY VIRTUE OF THE POWERS VESTED IN IT Y LAW, in a session duly assembled, to authorize the City Mayor Francisco Javier M. Zamora, to enter into a MOA with MWCI, for the implementation of the “Adopt-An-Estero/Water Body Program-Trash Trap Program” (AEWBP-TTP) which promotes collaboration between and among private and non-government sectors, local government unit/s and other government agencies to clean esteros and water bodies,
RESOLVED FURTHER, that the authority, issuance and approval hereof is subject to certain restrictions and to all existing laws, circulars, rules and regulations.
